AGREEMENT CNH.38.06/2023 issuing the Notice of Cancellation of the Mexican Official Standard NOM-026-SESH-2007, Guidelines for oil seismological prospecting works and specifications of maximum energy levels.
The National Hydrocarbons Commission (hereinafter, the Commission) is a Coordinated Regulatory Body in Energy Matters with technical, operational and management autonomy, with legal personality.
Pursuant to Article 5, Section VI of the Quality Infrastructure Law, in connection with Article 43, Section I, last paragraph of the Hydrocarbons Law, the Commission has the status of Standardizing Authority.
The National Consultative Committee for Standardization in Hydrocarbon Matters of the Ministry of Energy issued the Mexican Official Standard NOM-026-SESH-2007, “Guidelines for oil seismological prospecting works and specifications of maximum energy levels”, which was published in the Official Gazette of the Federation on August 29, 2007.
That with the Energy Reform of 2013, the Commission acquired powers to issue Mexican Official Standards with respect to activities related to reconnaissance and surface exploration, pursuant to Articles 38, Section I of the Law of the Coordinated Regulatory Bodies in Energy Matters and 43, Section I, subsection a) of the Hydrocarbons Law.
That as a result of the Energy Reform of 2013, the Ministry of Energy was left without powers to standardize oil seismological prospecting, and that said Mexican Official Standard did not have a second five-yearly review, in addition to the fact that it is currently obsolete, to the extent that it does not contemplate the entire universe of actors involved in this type of activity.
Article 42, section II of the Quality Infrastructure Law establishes that the National Commission for Quality Infrastructure (hereinafter, CNIC), may order the Standardizing Authorities to cancel Official Mexican Standards when the corresponding Standardizing Authority that issued the Official Mexican Standard runs out of authority in the matter.
That the CNIC, in its Second Ordinary Session held on August 24, 2023, by means of Agreement CNIC 2/2SO-2023 approved the cancellation of the Mexican Official Standard NOM-026-SESH-2007, “Guidelines for oil seismological prospecting works and specifications of maximum energy levels”.
That the second paragraph of article 42 of the Quality Infrastructure Law establishes that the competent Standardization Authority shall cancel and order the publication in the Official Gazette of the Federation within 30 days after the IASB orders it to do so.
That as a consequence of the aforementioned and based on the legal mandate conferred to this Coordinated Regulatory Body in Energy Matters, the Governing Body of this Commission issues the following:
AGREEMENT ISSUING THE NOTICE OF CANCELLATION OF THE OFFICIAL NORM
MEXICAN NOM-026-SESH-2007, “GUIDELINES FOR PROSPECTION WORKS
PETROLEUM SEISMOLOGY AND MAXIMUM ENERGY LEVEL SPECIFICATIONS”.”
FIRST. The notice of cancellation of NOM-026-SESH-2007, “Guidelines for oil seismological prospecting works and specifications of maximum energy levels”, published in the Official Gazette of the Federation on August 29, 2007, is hereby issued.
SECOND: It is instructed to take the necessary steps to publish the present Agreement by which the Notice of Cancellation of NOM-026-SESH-2007, “Guidelines for oil seismological prospecting works and specifications of maximum energy levels” is issued, in the Official Gazette of the Federation for its due diffusion among individuals.
THIRD. Register this Agreement CNH.38.06/2023 in the Public Registry of the National Hydrocarbons Commission. The foregoing, based on article 22, section XXVI, paragraph a), of the Law of the Coordinated Regulatory Bodies in Energy Matters.
