The SCJN through Jurisprudence 1a./J. 2/2024 (11th) determined that the State must guarantee the right to citizen participation and access to information on environmental matters during the process of drafting urban development programs.
The State must guarantee the right to citizen participation and access to information on environmental matters for interested persons who may feel that their right to a healthy environment has been affected, through workshops and consultations, so that they can present what they consider appropriate and, when the time comes, if pertinent, be included in the plan or program.
