AGREEMENT No. A/047/2022 of the Energy Regulatory Commission

The Energy Regulatory Commission has announced the issuance of new General Administrative Provisions, marking a milestone in the regulation of the hydrocarbons sector. The main purpose of this set of rules is to establish a clear and detailed framework for the authorization of cross participation in the sector, an initiative aligned with the second and third paragraphs of Article 83 of the Hydrocarbons Law.

The recently issued provisions comprehensively cover the procedure and requirements necessary to obtain cross participation authorizations. In addition, they introduce a rigorous methodology for analyzing the potential effects that such participation may have on competition, market efficiency and ensuring open and effective access.

A key aspect of these provisions is their interpretative function, providing administrative clarity on the definition and scope of cross-participation in the context of current legislation. This regulatory framework, included in its entirety in the Single Annex of the agreement, becomes an integral part of the agreement, ensuring a clear and accessible reference for industry players. With these measures, the Energy Regulatory Commission reinforces its commitment to promoting a competitive, efficient and transparent energy market, while facilitating regulatory compliance by companies in the sector.
