The Federal Constitution establishes the minimum social security guarantees for workers in the service of the State, leaving to the secondary law the regulation of procedures and requirements necessary to make those rights effective. Therefore, by restricting workers the possibility of changing the chosen or assigned pension system, the legislator does not affect their right to social security guaranteed in article 123, section B, subsection XI.
