En November 4, 2020, the magazine Energía a Debate published the following: A federal judge declared unconstitutional the Reliability Policy issued by the Ministry of Energy (Sener) on May 15, which sought to put a brake on private power generation plants based on renewable energies.
Reforma reported this morning that the Second District Judge in Economic Competition matters, Juan Pablo Gómez Fierro, notified on Tuesday of this week the sentence by which he granted amparo to EGP Magdalena Solar, one of the many companies that challenged the Agreement by which the Reliability, Safety, Continuity and Quality Policy in the National Electric System (SEN) is issued, published in the Official Gazette of the Federation by the agency headed by Rocío Nahle García.
This ruling was issued two weeks after the Supreme Court of Justice of Mexico unanimously granted the indefinite suspension of the so-called “Nahle Policy”, an appeal filed by the Federal Economic Competition Commission (Cofece).
Judge Gómez Fierro's ruling adds to a series of setbacks to regulatory attempts by the government of President Andrés Manuel López Obrador to remove energy produced by private power plants, particularly solar photovoltaic and wind power, from the national electricity system.
