Today, February 9, 2021, the Official Gazette of the Federation published the following:
The calculation and adjustment of the Final Tariffs to be applied individually by the Subsidiary Productive Company CFE Basic Services Supplier is determined, which is attached to this Agreement as Sole Annex and is deemed to be reproduced herein as if it were inserted, forming an integral part of this Agreement.
This Agreement will become effective as of January 1, 2021 and will be applicable to determine the calculation and adjustment of the Final Tariffs that will apply to the Subsidiary Productive Company CFE Suministrador de Servicios Básicos, corresponding to fiscal year 2021 and will remain in force as long as it is not modified. As of its entry into force, this tariff regulation leaves without effect Agreements A/038/2019 dated December 16, 2019 and A/029/2020, dated September 29, 2020, by which the Energy Regulatory Commission issued the Methodology to determine the calculation and adjustment of the Final Tariffs that will apply to the Subsidiary Productive Company CFE Basic Services Supplier from January 1 to December 31, 2020 and modified Agreement A/038/2019 and its Sole Annex.
The Subsidiary Productive Company CFE Basic Services Supplier is instructed to deliver to the Energy Regulatory Commission, the information required to apply the review mechanism and monthly update of the generation costs of the Legacy Contracts for the Basic Supply, of the Wholesale Electricity Market, Long-Term Auctions and the generation costs of the Small Electric Systems in the Micro-Network regime that operate in the Yucatan Peninsula and the Small Electric System in Simplified Operation Regime in Baja California, incurred by the Subsidiary Productive Company CFE Suministrador de Servicios Básicos y Productos Asociados, in accordance with the provisions of the Sole Annex of this Agreement, no later than the first 20 days of each month. In the event that CFE Basic Services Supplier does not deliver the corresponding information on time or does not comply with the required characteristics, the Energy Regulatory Commission will make the calculation and adjustment with the best information available at the time, without any objection from CFE Basic Services Supplier.
The Energy Regulatory Commission will calculate monthly the Final Basic Supply Tariffs using the Methodology contained in the Sole Annex of this Agreement and will notify the value of the same to CFE Basic Service Supplier, within five working days prior to the month of its application.
The calculation memory used to determine the Final Basic Supply Tariffs will be published on the Energy Regulatory Commission's website within two business days after the notification referred to in the immediately preceding Agreement of this instrument.
CFE Suministrador de Servicios Básicos is instructed to publish monthly through its website, the Final Tariffs of Basic Supply within a term no longer than two business days after the notification referred to in the Seventh Point of Agreement of this instrument.
