AGREEMENT CNH.30.06/2023 whereby the Guidelines for Abandonment, Resignation and Return are issued.

Chapter I

General Provisions

Article 1. Purpose. The purpose of these Guidelines is to regulate the procedures and obligations to be followed by the Petroleum Operators regarding Abandonment, withdrawal and disposal of Materials associated to oil activities; as well as the termination procedures and conditions for the Return of the Contract Areas, the applicable in case of Renunciation or revocation of Assignment Areas, and the corresponding financial mechanisms to face the obligation of Abandonment.
To this effect, the Guidelines regulate:
I. Coordination mechanisms with the Agency and the Secretariat for the regulation and supervision of Abandonment activities;
II. The obligation of the Oil Operators to establish financial mechanisms for Abandonment, including, as the case may be, the Abandonment Trust;
III. Obligations related to the Abandonment of Wells and Materials;
IV. The procedure for the authorization of disposal and removal of Materials;
V. The obligations and procedures for Contractors to deliver the Contract Areas;
VI. The obligations and procedures for Assignees to give notice of Resignation of the Assigned Area, as well as the plans for operational continuity or Abandonment of the Assigned Area, as the case may be, and
VII. The mechanisms of supervision of these Guidelines and the applicable sanctions.
Article 2. Scope of application, interpretation and supplementary application. The Guidelines are of a general nature and of mandatory observance for the Petroleum Operators that carry out Hydrocarbon Exploration and Extraction activities and apply throughout the national territory.
For the purposes of the Guidelines, the activities of Abandonment shall be those provided for in Section I of Article 3 of this regulatory body. The Commission shall be responsible for the interpretation and application of the Guidelines.
The Commission may resolve specific consultations or issue interpretation agreements and general criteria to harmonize the Guidelines with the Allocations, Contracts and other applicable Regulations.
In those cases not provided for in the Guidelines, the Federal Law of Administrative Procedure will be applied in a supplementary manner.
