AGREEMENT AE/FEMDH/001/2023
Articles 12, 13 and 25, second paragraph of the Law of the Attorney General's Office of the Republic provide that the Specialized Prosecutor's Offices shall enjoy technical and managerial autonomy, within the scope of their competence, and therefore their heads are empowered to issue the necessary legal instruments in order to organize, coordinate, plan, schedule, execute, administer, direct, control, distribute and follow up the activities of the personnel and administrative units assigned to them;
Article 10 of the Organic Statute of the Attorney General's Office establishes that, according to their operational needs, the heads of the administrative units shall issue their Organizational Manuals, in accordance with the guidelines issued by the head of the Office of the Chief of Staff;
Article 31, section IV of the Organic Statute of the Attorney General's Office empowers the heads of the Specialized Prosecutor's Offices to issue, among others, their Organizational Manuals;
That article 170, section XI of the Organic Statute of the Attorney General's Office empowers the head of the Office of the Chief of Staff to issue guidelines for the issuance of Organization Manuals based on technical and austere criteria;
On September 18, 2023, the Guidelines L/OM/003/2023 for the preparation of the Organization and Procedures Manual of the Attorney General's Office and the Organization and Procedures Manuals of the Attorney General's Office were published in the Official Gazette of the Federation, issued by the Chief of Staff;
That the Eighth transitory provision of Guidelines L/OM/003/2023, provides that in order to activate the programmatic structure for fiscal year 2024, the heads of the Units provided for in Article 11 of the Law of the Office of the Attorney General of the Republic may issue partial Organization Manuals; and
That in exercise of the technical and managerial autonomy conferred upon me, within the scope of my competence, I have had the good will to issue the following:
SHIPPING AGREEMENT
SOLE. The Organizational Manual of the Specialized Human Rights Prosecutor's Office (Partial) is hereby issued, in accordance with the attached document that forms an integral part of this Issuance Agreement.
TRANSITIONS
First. This Organizational Manual of the Specialized Human Rights Prosecutor's Office (Partial) will be published in the Official Gazette of the Federation and will enter into force on January 1 of fiscal year 2024.
Second. All conflicting provisions are hereby repealed.
Third. As of the entry into force of this Manual, the programmatic structures of the Specialized Human Rights Prosecutor's Office will be activated.
Fourth. The head of the Specialized Human Rights Prosecutor's Office and the heads of the Administrative Units attached to it shall prepare the corresponding closing and opening minutes no later than December 31, 2023.
Fifth. As of the entry into force of this Organizational Manual, the knowledge, processing, attention and resolution of the matters in charge of the Administrative Units attached to the Specialized Human Rights Prosecutor's Office shall be carried out taking into consideration the following:
- Special Prosecutor's Office for Attention to Crimes Committed against Freedom of Expression, provided for in Article 5, section VII, paragraph a., of the Organic Statute of the Attorney General's Office;
- Special Prosecutor's Office for the Investigation of the Crimes of Enforced Disappearance, provided for in Article 5, section VII, paragraph b., of the Organic Statute of the Attorney General's Office;
- Special Prosecutor's Office for the Investigation of the Crime of Torture, provided for in Article 5, section VII, paragraph c., of the Organic Statute of the Office of the Attorney General of the Republic;
- Special Prosecutor's Office for the Investigation of Crimes Related to Migrants and Refugees, provided for in Article 5, section VII, paragraph d., of the Organic Statute of the Attorney General's Office;
- Special Prosecutor's Office for the Investigation of Crimes related to Recommendations of the National Human Rights Commission, provided for in Article 5, section VII, paragraph e., of the Organic Statute of the Attorney General's Office;
- Special Prosecutor's Office for Crimes Committed by Indigenous and Afro-Mexican Persons, provided for in Article 5, section VII, paragraph f., of the Organic Statute of the Office of the Attorney General of the Republic;
- Unit for the Follow-up of Complaints, Conciliations and Recommendations of the National Human Rights Commission, provided for in article 5, section VII, paragraph g., of the Organic Statute of the Attorney General's Office;
- Psychosocial Care Unit, provided for in Article 5, section VII, paragraph h., of the Organic Statute of the Office of the Attorney General of the Republic, and
- Community Services Unit provided for in article 5, section VII, paragraph i., of the Organic Statute of the Attorney General's Office of the Republic.
Any discrepancy that may arise in the Administrative Units attached to the Specialized Prosecutor's Office for Human Rights, with respect to the matters they must attend to, shall be resolved by the head of said Specialized Prosecutor's Office.
Sixth. As of the entry into force of this Manual and for purposes of this Manual:
- The Post-Position of the person in charge of the Specialized Prosecutor's Office for Human Rights, will budgetarily support the Post-Position of the person in charge of the Specialized Prosecutor's Office for Human Rights provided for in Article 5, Section VII, of the Organic Statute of the Office of the Attorney General of the Republic.
- The Post-Position 16067 of Head of Unit, will budgetarily support the Post-Position of the head of the Special Prosecutor's Office for Attention to Crimes Committed against Freedom of Expression, provided for in Article 5, section VII, paragraph a., of the Organic Statute of the Office of the Attorney General of the Republic;
- The Position-Position of 36176 of Head of Unit, will budgetarily support the Position-Position of the person in charge of the Special Prosecutor's Office for the Investigation of the Crimes of Enforced Disappearance, provided for in Article 5, section VII, subsection b., of the Organic Statute of the Attorney General's Office of the Republic;
- The Post-Position 42382 of Head of Unit, will budgetarily support the Post-Position of the head of the Special Prosecutor's Office for the Investigation of the Crime of Torture, provided for in Article 5, section VII, subsection c., of the Organic Statute of the Office of the Attorney General of the Republic;
- The Post-Position 42383 of Head of Unit will budgetarily support the Post-Position of the head of the Special Prosecutor's Office for the Investigation of Crimes related to Migrants and Refugees, as provided in Article 5, section VII, paragraph d., of the Organic Statute of the Attorney General's Office of the Republic;
- The Post-Position 7 of Unit Head will budgetarily support the Post-Position of the head of the Special Prosecutor's Office for the Investigation of Crimes related to Recommendations of the National Human Rights Commission, provided for in Article 5, section VII, paragraph e., of the Organic Statute of the Office of the Attorney General of the Republic;
- The Post-Position 16307 of Head of Unit will budgetarily support the Post-Position of the Head of the Unit for Follow-up of Complaints, Conciliations and Recommendations of the National Human Rights Commission, provided for in Article 5, section VII, subsection g., of the Organic Statute of the Office of the Attorney General of the Republic;
- The Post-Position 18 of Executive Administrator, will budgetarily support the Post-Position of the person in charge of the Psychosocial Attention Unit, provided for in Article 5, section VII, paragraph h., of the Organic Statute of the Attorney General's Office of the Republic;
- The Post-Position 42384 of Unit Head will budgetarily support the Post-Position of the head of the Community Services Unit, provided for in Article 5, section VII, paragraph i., of the Organic Statute of the Attorney General's Office, and
- The 41207 Ministerial Supervision Post-Position attached to the Special Prosecutor's Office for Human Rights will budgetarily support the Post-Position of Secretary of Support to the Office of the Special Prosecutor of the Special Prosecutor's Office for the Investigation of the Crime of Torture, provided for in Article 5, section VII, subsection c., of the Organic Statute of the Attorney General's Office of the Republic.
Seventh. The Positions-Positions that integrate the programmatic structures of the Specialized Human Rights Prosecutor's Office will be created at compensated costs and staggered terms, according to the needs of the service.
Eighth. For the purposes of planning, administration, exercise and budgetary control of Chapter 1000 “Personal Services” of the expenditure and of this Manual, the converter of Responsible Units will come into effect on January 1, 2024 or according to the activation of the new programmatic structures in terms of the transitory provisions of the Organization Manuals, including those of a partial nature.
